Who this covers

This policy covers the Chromatic Labs website, the canvas, and Chromatic when you connect it from a chat app such as ChatGPT. Contact us at hello@chromaticlabs.co.

Information we collect

• Account details: your name, email address, and the sign-in provider you use.
• Work you put on a canvas: prompts, scripts, reference images, and other files you upload.
• Files we make for you: the images and videos a generation returns.
• Chat-app requests: when you connect Chromatic, the prompt, the images attached to that job, and the account you sign in with. We do not receive the rest of that chat.
• Billing: subscription status, credit balance, and a customer id from our payment processor. We do not store your card number.
• Support messages you send us, including your email and the message.
• Device and use data: IP address, browser type, pages visited, and product events such as a generation starting or failing.

How we use it

• To run your account, canvases, and generations.
• To make the image or video you asked for, including from a connected chat app.
• To bill the account and keep the credit balance.
• To answer a support request.
• To protect the service against abuse and fraud.
• To understand which parts of the product people use.

Who receives it

• Hosting, database, and file-storage providers that keep the account and the canvas files.
• The sign-in provider that checks your login.
• The model provider that runs a generation. It receives the prompt and reference images for that job.
• Our payment processor, which handles the payment. We keep the customer id and the subscription status.
• Our product analytics provider, which receives usage events.
• A chat app you choose to connect, such as ChatGPT. That app already has what you type there. We receive only the request for the job.

We do not sell personal information. We do not collect health information, government identity numbers, or passwords for other services.

How long we keep it

• Canvas files, prompts, and generated images and videos stay until you delete that work, or until we delete the account after you ask.
• Account details stay while the account is open. After you ask us to delete the account, we delete them within one month, except records we must keep.
• Billing records stay for the period tax and accounting law requires.
• Security logs and product analytics stay while we need them to run and protect the service, and are then deleted or de-identified.

Your choices

• You can delete canvases and files in the product.
• You can disconnect Chromatic in the chat app where you connected it.
• Email hello@chromaticlabs.co to access, correct, or delete your account and the personal data we hold. We respond within one month.
• You can block cookies in your browser. Signing in needs cookies to keep the session.

Cookies and logs

We use cookies to keep you signed in and to remember a session. Our hosting and analytics providers also record IP address, browser type, and the time of a request so we can run and protect the service. This is not used to sell ads.

CCPA Privacy Rights (Do Not Sell My Personal Information)

Under the CCPA, California consumers have the right to:

• Request disclosure of personal data we have collected
• Request deletion of personal data we have collected
• Request that we do not sell their personal data

GDPR Data Protection Rights

Every user is entitled to:

• Right to access: Request copies of your personal data. We may charge a small fee.
• Right to rectification: Request correction or completion of inaccurate or incomplete information.
• Right to erasure: Request erasure of your personal data under certain conditions.
• Right to restrict processing: Request restriction of processing under certain conditions.
• Right to object: Object to our processing of your personal data under certain conditions.
• Right to data portability: Request transfer of your data to another organization or to you.

Children's Information

We encourage parents and guardians to observe and guide their children's online activity.

Chromatic Labs does not knowingly collect personal information from children under 13. If your child has provided such information, email hello@chromaticlabs.co and we will remove it from our records.
